1. What Daypair is — and is not

Daypair is a wellness and accountability companion. It reads daily totals you have authorized from Apple Health, compares them against commitments you wrote yourself, and shows one person you chose the level of detail you selected.

Daypair is not:

• a food logger — it does not record meals, and you keep using whatever app you already log in;
• a source of nutrition or fitness targets — you set your own, or use targets given to you by a qualified professional;
• a medical device, and not a provider of medical advice, diagnosis, or treatment;
• a substitute for care from a doctor, dietitian, or other qualified professional;
• a public social network — a pact is exactly two people, and there are no profiles, leaderboards, or feeds;
• a wager, a penalty, or a stake of any kind. Nothing is ever at risk but the commitment itself.

Nothing in Daypair is medical advice. Decisions about your diet, activity, or health are yours, and you should take them with a qualified professional where that matters. If you have or suspect a medical condition, or a history of disordered eating, talk to a professional before using an app to track intake. If you are having a medical emergency, call your local emergency number.

2. You must be 18

Daypair is for adults 18 and over, and you confirm your age during setup. Both members of a pact must meet this requirement. We do not knowingly permit anyone under 18 to use Daypair, and we will close an account if we learn its holder is under 18.

3. Your account

Sign in with Apple. You are responsible for keeping access to your Apple ID secure. You may use Apple’s Hide My Email; Daypair works the same either way.

One account per person. Do not create an account for anyone else, and do not share yours.

4. Apple Health

Daypair reads only the Apple Health categories you authorize, and only ever reads — it never writes. You can change or withdraw that access at any time in the iOS Health app.

Withdrawing access does not delete what we already hold; use the deletion process in section 9 for that.

Daypair depends on the accuracy of what your logging app writes to Apple Health. We do not verify it and cannot be responsible for it. Apple Health returning no data is not the same as a total of zero, and Daypair does not treat it as one.

5. Pacts, and how you treat your teammate

A pact is two people who agreed to it. Within one:

• You cannot set, edit, or delete your teammate’s commitments. Nobody in Daypair has authority over anyone else’s commitments. You are peers.
• Check-ins come from a fixed list of approved messages, are rate-limited, and respect the recipient’s quiet hours.
• You control what you share, per commitment, and status-only is the default.
• You can pause sharing, leave the pact, or block the other person at any time, and access ends immediately.

Blocking is final for that relationship. An old invitation cannot restore it.

Do not use Daypair to pressure, coerce, monitor, or control another person. Do not invite someone who has not agreed to be invited. We may suspend or close an account that does.

6. Your content

Your commitment labels and display name are yours. You give us only the permission we need to operate Daypair for you — to store that content, and to show it to the one teammate you chose at the level you chose. We claim no ownership, and we do not use your content to train machine-learning models.

Do not enter anything unlawful in a free-text field, or anything that infringes someone else’s rights.

7. Daypair Pro

Daypair’s core is free. Daypair Pro is an optional auto-renewing subscription bought through Apple.

• Prices are shown in the app in your local currency, from the App Store, before you buy.
• Payment is charged to your Apple ID on confirmation of purchase.
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Renewal is charged within 24 hours of the period ending.
• Manage or cancel in your Apple account settings. Deleting your Daypair account does not cancel your subscription — only you can do that, in your Apple settings.
• If a free trial is offered, any unused part is forfeited when you buy a subscription that covers the same thing, as Apple requires.
• Restore Purchases is available on the paywall and in subscription settings.

Refunds are handled by Apple, not by us, under Apple’s policies. We cannot issue a refund for an App Store purchase.

Privacy controls, pausing, blocking, and account deletion are never behind the paywall. We will not put a privacy or safety control behind a subscription.

We may change what Pro includes or what it costs. If a change is to your disadvantage, we will give notice in the app before it applies to a renewal, and you can cancel before then.

8. Availability

We may change, suspend, or discontinue any part of Daypair. If we discontinue it entirely we will give reasonable notice and a way to get your data out. Daypair depends on Apple Health, the App Store, and our providers, and we do not promise uninterrupted service.

9. Ending this agreement

You may stop using Daypair at any time, and you may delete your account from inside the app: Settings → Account → Delete account. Deletion is immediate and permanent. You can also email support@daypair.app and ask us to do it, and we will complete it within 45 days. Our Privacy Policy sets out exactly what is removed.

We may suspend or close your account if you break these terms, if we must for legal reasons, or if we discontinue Daypair. Where circumstances allow, we will tell you first.

Deleting your account ends this agreement, except for the sections that are meant to survive it: 6 (as to content already shared), 11, 14, 15, and 17.

10. Our intellectual property

Daypair, its name, and its design are ours. These terms give you permission to use the app, not ownership of it. Do not copy, reverse-engineer, resell, or build a competing service out of Daypair, except where the law says you may regardless of what we write here.

Daypair reads data from Apple Health and works alongside nutrition and fitness apps. Naming one describes compatibility and nothing else. Daypair is not affiliated with, endorsed by, or partnered with any nutrition or fitness app, and third-party names remain the property of their owners.

11. Your responsibilities

You are responsible for your own health decisions, for the accuracy of what you log elsewhere, for the targets you set, and for how you treat your teammate.

12. Third-party services

Daypair depends on Apple Health, Sign in with Apple, the App Store, and the providers listed in our Privacy Policy. Their own terms apply to their services and we are not responsible for them.

13. Provisions Apple requires

Because Daypair is distributed through the App Store, these terms apply:

1. These terms are between you and us only, not with Apple. Daypair and its content are our responsibility, not Apple’s.
2. Apple has no obligation to furnish any maintenance or support for Daypair.
3. If Daypair fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price if there was one. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Daypair, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
4. Apple is not responsible for addressing any claim by you or a third party relating to Daypair or your use of it, including product liability claims, any claim that Daypair fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar legislation.
5. If a third party claims Daypair infringes its intellectual property, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
6. You represent that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government prohibited-party list.
7. You must comply with any applicable third-party terms when using Daypair.
8. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Disclaimers and limitation of liability

Daypair is provided “as is” and “as available”. To the maximum extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Daypair will be uninterrupted, error-free, or that any total it shows is accurate — it reflects what your logging app wrote to Apple Health.

We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or lost data, arising out of your use of Daypair. Our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or twenty-five U.S. dollars.

Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded, and nothing in these terms limits your rights under the consumer health data laws described in our Consumer Health Data Privacy Policy.

15. Governing law and disputes

These terms are governed by the laws of California, without regard to conflict-of-laws rules. Disputes go to the state or federal courts located in California, and we each consent to their jurisdiction.

Please email us first. Most problems are faster to fix that way than through a court.

17. The rest

These terms, with the Privacy Policy and the Consumer Health Data Privacy Policy, are the whole agreement between us about Daypair. If a court finds part of them unenforceable, the rest stays in force. Our not enforcing something is not a waiver of it. You may not transfer these terms; we may transfer them to a successor if we give you notice.

Changes. If we change these terms we will raise the version number and the effective date above. For a material change we will tell you in the app before it takes effect. Continuing to use Daypair after that means you accept the change; if you do not, stop using Daypair and ask us to delete your account.
